Hearl Terms of Service

These Terms of Service ("Terms") govern your use of Hearl, our iPhone app, and the website https://hearl.app (together, the "Services"), provided by Wizora LTD ("Wizora", "we", "us", "our"), a company registered in England and Wales.

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. About Hearl

Hearl turns a topic into an audio series. You name a topic and, if you like, add your own web pages, files or notes. Hearl researches the topic, plans a series of episodes that you can steer, and, when you choose, writes and voices episodes for you to listen to. Research, planning, writing and voicing are done by artificial intelligence, currently Google's Gemini API, as described in section 4 and our Privacy Policy.


2. Eligibility

You must be at least 18 years old to use the Services. By using them, you confirm that you are, and that you can enter into a binding contract. Hearl is for personal, non-commercial use.


3. Your account

You need an account to use Hearl, including the free series. You can sign in with Apple, with Google, or with an email address and password.

You are responsible for:

  • giving accurate information when you sign up;
  • keeping your sign-in details secure; and
  • everything that happens under your account.

Tell us straight away at [email protected] if you think someone else has used your account. One person may not share an account with others or hold several accounts to get around a limit, such as the one free series.


4. AI-generated content

How it works. Episodes, plans, titles, scripts and transcripts ("Generated Content") are produced by artificial intelligence from your topic, your choices, the sources you add and research from web search. Before Hearl sends anything to our AI provider for the first time, the app asks your permission, separately from these Terms.

It can be wrong. AI can misunderstand a source, miss context, mix up facts or state something that is not true, even when it sounds confident. Each episode shows the sources it was built from; check them for anything that matters to you. We do not guarantee that Generated Content is accurate, complete or up to date.

It is not advice. Generated Content is for learning, curiosity and entertainment. It is not medical, legal, financial, tax, psychological or other professional advice, and it is not a substitute for a qualified professional. Do not rely on it to make decisions about your health, money, legal position or safety. Some catalog content, such as the free romance series, is fiction.

Limits on what Hearl makes. Hearl may decline a topic or a source, for example when it asks for sexual content, content involving minors, instructions for self-harm or other dangerous content. When that happens before voicing, no minutes are used; when voicing cannot finish, the minutes are returned.


5. Your content and sources

What you own. You keep all rights you have in what you add to Hearl: topics, notes, pasted text, files and links ("Your Content"). As between you and us, you may use the Generated Content made for you for your own personal, non-commercial purposes.

What you let us do. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process and transform Your Content, including sending it to our AI provider and fetching the web pages you link, only as needed to provide the Services to you. This licence ends when Your Content is deleted from our systems, as described in the Privacy Policy.

Your promises about sources. By adding a source you confirm that you have the right to use it this way: it is your own material, it is openly available, or you have permission from its owner. Do not upload material you are not allowed to share with a service like Hearl, for example confidential documents or material whose licence forbids it. Hearl makes private episodes for you alone; do not use it to republish other people's work.

Web pages. When you add a link, our servers fetch that page under the rules at hearl.app/bot. Some pages cannot be used, for example pages behind a login or paywall or sites that ask not to be read automatically.

Copyright complaints. If you believe content in Hearl infringes your rights, email [email protected] with the content concerned, the work you believe it infringes and your contact details. We will review it and remove content where appropriate.


6. Acceptable use

You agree not to:

  • use the Services unlawfully, or to infringe anyone's rights, including copyright and privacy;
  • try to make Hearl produce sexual content involving minors, sexually explicit content, instructions for self-harm, or content that promotes violence, terrorism or hatred against people;
  • upload malware, or material you are not allowed to share (see section 5);
  • try to get around limits, the one free series, the minutes system or the App Store's payment system;
  • access the Services with bots or scripts, scrape them, or overload our systems;
  • reverse engineer the app, except where the law allows it; or
  • access other people's accounts or our systems without permission.

We may refuse requests, remove content, or suspend or close accounts that break these Terms.


7. Minutes, memberships and packs

Minutes. Voicing an episode uses minutes: one minute of voiced audio uses one minute, for one narrator or two hosts alike. Minutes are taken when you choose to voice an episode and are returned automatically if voicing fails or if you cancel before the audio exists. Planning a series does not use minutes. Minutes have no cash value, cannot be transferred to another account or exchanged, and are used only in Hearl.

Memberships. Hearl offers two monthly memberships, bought through the Apple App Store:

  • Curious Mind: 60 minutes each month. A series can have up to 10 planned episodes; each episode added after that uses 2 extra minutes.
  • Pro Scholar: 150 minutes each month, with unlimited episodes per series and no fee for adding more.

Membership minutes are added at the start of each billing period and expire at the end of that period if unused. There is no free trial.

Minute packs. Packs of 30, 100 or 250 minutes are one-time purchases. Pack minutes never expire while your account exists. Series voiced with pack minutes and no membership follow the Curious Mind rule for added episodes. If you have both, membership minutes are used first.

Prices. Prices are shown in the App Store in your local currency before you buy, and may include taxes. We may change prices for future periods; Apple will tell you about a price increase for a membership as its rules require.

Automatic renewal. Memberships renew automatically each month and are charged to your Apple ID unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel a membership at any time in your iPhone's Settings → [your name] → Subscriptions, or from Profile in Hearl. After you cancel, you keep your membership and its minutes until the end of the period you paid for. Deleting the app or your account does not cancel a membership.

Refunds. All purchases are processed by Apple, and Apple handles refunds under its own policies. We cannot issue App Store refunds ourselves. To ask for one, visit reportaproblem.apple.com. If Apple refunds a purchase, the minutes it added may be removed from your balance.

Upgrades and downgrades. Moving from Curious Mind to Pro Scholar takes effect immediately; moving down takes effect at your next renewal, as the App Store manages it.

Fair-use limits. To keep Hearl reliable and affordable for everyone, each account can make up to 10 plans a day and voice up to 300 minutes per calendar month, whatever it has bought. A series can use up to 10 of your own sources, and you can add up to 30 sources a day. We may change these limits and will show the current ones in the app or on hearl.app/support.

If you close your account. Unused minutes, including pack minutes, are lost when your account is deleted, and are not refunded, except where the law requires otherwise.


8. Free features

Every account can listen to Hearl's free series and plan one series of its own for free, including research, sources and steering suggestions. Deleting that series does not give the free plan back. Voicing your own episodes, adding episodes and deep dives need a membership or minutes. We may change the free series and free features, and will not remove something you have paid for.


9. Intellectual property

The Services, including the app, the website, the Hearl name and mascot, the design and the free catalog series, belong to Wizora LTD or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, under these Terms and the App Store's usage rules. You may not copy, sell, rent or redistribute the Services or the free series except as these Terms allow.


10. Third-party services

Hearl relies on third-party services, including Apple (App Store and Sign in with Apple), Google (Sign in with Google, Google Cloud and the Gemini API), Supabase, RevenueCat, Expo and Cloudflare. Their own terms and policies may apply to you. Episodes cite third-party sources and link to third-party websites; we do not control or endorse them.


11. Availability and changes

We work to keep Hearl available, but we do not promise it will always be available or free of errors. We may pause planning or voicing for maintenance or to protect the service, for example if our AI costs for a month run unusually high; when that happens, nothing is charged, and minutes for voicing that could not finish are returned. We may add, change or remove features. If we stop offering Hearl altogether, we will tell you in advance where we reasonably can.


12. Disclaimers

To the fullest extent the law allows, the Services and all Generated Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

Nothing in these Terms affects the rights you have as a consumer that cannot be excluded by law. If you are a consumer in the UK or the EU, you have legal rights that the Services must be as described, fit for purpose and provided with reasonable care and skill.


13. Limitation of liability

To the fullest extent the law allows, Wizora LTD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Services or Generated Content, or from decisions you make based on it.

Our total liability for all claims relating to the Services or these Terms is limited to the greater of (a) the amount you paid for Hearl in the 12 months before the claim and (b) US$100.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited or excluded by law.


14. Indemnity

To the extent the law allows, you agree to compensate Wizora LTD for claims, losses and reasonable legal costs that arise because you broke these Terms, broke the law, or added content you did not have the right to use.


15. Ending your use

You can stop using Hearl at any time and delete your account in the app (Profile → Delete account). What deletion removes, and when, is described in the Privacy Policy.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Services. Where reasonable, we will tell you first and give you a chance to export your data.

Sections 12 (Disclaimers), 13 (Limitation of liability), 14 (Indemnity) and 17 (Governing law and disputes) continue to apply after your use ends.


16. Changes to these Terms

We may update these Terms. We will post the new version at hearl.app/terms and change the "Last updated" date. If a change materially affects you, we will tell you in the app before it takes effect. If you keep using Hearl after that, the new Terms apply; if you do not agree, stop using Hearl and delete your account.


17. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction over any dispute arising from them or the Services. If you live elsewhere, you keep the protection of the mandatory consumer laws of the country or state where you live, and you may bring a claim in your local courts where those laws allow.

18. Apple App Store terms

Because you get Hearl from the Apple App Store:

  • These Terms are between you and Wizora LTD only, not Apple. Wizora LTD, not Apple, is responsible for Hearl and its content.
  • Apple has no obligation to provide maintenance or support for Hearl.
  • If Hearl fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any). To the fullest extent the law allows, Apple has no other warranty obligation for Hearl.
  • Wizora LTD, not Apple, is responsible for handling any claims relating to Hearl, including product liability claims, claims that Hearl fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
  • If a third party claims that Hearl infringes its intellectual property rights, Wizora LTD, not Apple, is responsible for investigating, defending and settling that claim.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If these Terms conflict with Apple's Licensed Application End User License Agreement, these Terms apply, to the extent Apple's rules allow.


19. General

  • Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Services.
  • Severability: if a court finds part of these Terms invalid, the rest stays in effect.
  • No waiver: if we do not enforce a right straight away, we can still enforce it later.
  • Transfer: you may not transfer your rights under these Terms. We may transfer ours to a company that takes over Hearl, and your rights will not be reduced.
  • Events outside our control: we are not responsible for delays or failures caused by events we cannot reasonably control.
